These Terms & Conditions govern your use of openwaters.lk and bookings for accommodation and related services at Open Waters Escape Villa (“Open Waters”, “we”, “us” or “our”). By using our website or making a booking, you agree to these Terms.
Bookings and payment
- A booking is subject to availability and is confirmed only when we issue written confirmation.
- You must provide accurate, complete, and current booking and contact information.
- Prices, availability, promotions, taxes, and service inclusions may change until a booking is confirmed.
- Any deposit, balance, or payment deadline shown during booking or in our confirmation must be met. We may cancel an unpaid booking after notifying you where reasonably practicable.
- Payments are processed through secure third-party payment providers. You authorise us and our payment providers to charge the agreed amount for your confirmed booking and any authorised additional services.
Check-in, check-out, and guests
- Check-in and check-out times will be communicated with your booking confirmation or by our team.
- Guests may be asked to provide valid identification at check-in where required by law or for security purposes.
- Only the guests included in the confirmed booking may occupy the accommodation, unless we approve otherwise.
- The person making the booking is responsible for the conduct of all guests in their party.
- Guests must comply with reasonable property rules, safety instructions, and staff directions.
Guest conduct and property care
Guests must treat the villa, rooms, facilities, furnishings, and other guests with care and respect. Unlawful, disruptive, unsafe, abusive, or damaging behaviour is not permitted.
You are responsible for loss of, or damage to, property caused by you or members of your party beyond normal wear and tear. We may charge reasonable costs for repair, replacement, extra cleaning, or losses resulting from such damage.
We may refuse entry, remove a guest, or end a stay where necessary to protect the safety, comfort, property, or legal rights of Open Waters, guests, staff, or others. Refunds will not be due where the removal or termination results from a breach of these Terms.
Services, experiences, and third parties
Services such as meals, airport transfers, laundry, local tours, cooking classes, boat rides, or other experiences may be subject to availability, additional charges, weather, operating conditions, and separate provider terms.
Where an external provider supplies a service, we may assist with arrangements but are not responsible for that provider’s acts, omissions, delays, cancellations, or service quality, except where responsibility cannot lawfully be excluded.
Cancellations and refunds
Our Refund & Cancellation Policy forms part of these Terms. Please read it before booking. Where you book through a third-party platform, that platform’s cancellation rules may also apply.
Website content
We aim to keep descriptions, photographs, room details, prices, and availability accurate. However, minor differences, errors, or updates may occur. Images are illustrative and may not show every room, feature, or current condition exactly.
We may correct errors, update information, change website content, or cancel a booking affected by a material pricing or availability error. If we cancel a paid booking for this reason, we will refund the amount paid for that booking.
Intellectual property
The website and its content—including text, photographs, graphics, branding, logos, and design—belong to Open Waters or its licensors and are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, or use this material commercially without prior written permission.
Liability
To the fullest extent permitted by applicable law, Open Waters is not liable for indirect, incidental, special, or consequential losses, including loss of enjoyment, profits, data, or opportunity.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Our total liability relating to a booking will not exceed the amount paid to us for the affected booking, except where applicable law requires otherwise.
Guests remain responsible for safeguarding their personal belongings. We recommend that guests obtain suitable travel insurance for cancellation, medical needs, personal belongings, and travel disruption.

Our collection and use of personal information are explained in our Privacy Policy.
Changes to these Terms
We may update these Terms from time to time. The version published on the website at the time of your booking applies to that booking unless a change is required by law or we notify you otherwise.
Governing law
These Terms are governed by the laws of Sri Lanka. Any dispute will be subject to the jurisdiction of the courts of Sri Lanka, unless applicable law provides otherwise.
